Terms & Conditions

These terms govern your use of TrueTest, the e-exam platform operated by Virtual Data IT. Please read them carefully before subscribing or accessing the service.

Acceptance of these Terms

These Terms & Conditions govern the relationship between Virtual Data IT ("the Company", "we") and any institution, administrator, instructor, proctor, or examinee ("User", "you") who accesses or subscribes to the TrueTest platform ("the Service") via the website or any associated application.

By creating an account, signing a subscription order, or otherwise using the Service, you confirm that you have read, understood, and agreed to be bound by these terms, together with our Privacy Policy and any order form or addendum executed between your organization and the Company.

We may amend these terms in whole or in part at any time. Material changes will be communicated to subscribed organizations through the platform or by email; continued use of the Service after the effective date constitutes acceptance of the updated terms.

1. Accounts, Roles & Eligibility

  • The Service is provided to legal entities (universities, schools, training centers, and exam centers) and to the users they authorize. Personal use outside an authorized organizational tenant is not permitted.
  • When provisioning a tenant or user, the organization must provide accurate identification, contact, and billing information. The Company may suspend any account whose details cannot be verified.
  • Each user account is personal and non-transferable. Sharing credentials across multiple individuals, devices, or sessions in a way that bypasses licensed user limits is prohibited.
  • The organization is responsible for the actions of every user it provisions, including students, instructors, proctors, and administrators.

2. Subscriptions, Plans & Billing

  • Access to the Service is granted under a subscription or order form that defines the plan, term, licensed user counts, and applicable fees.
  • Pricing is published on the website or in a written quote and may include institutional discounts, pilot terms, or limited-time promotions. Taxes and currency conversion fees are billed at applicable rates.
  • Unless otherwise agreed in writing, subscriptions auto-renew at the end of each term at the then-current list price. Termination and renewal handling is described in the Refund & Cancellation Policy.
  • Payments are accepted via supported channels including credit/debit cards (Visa, Mastercard) and bank transfer for institutional invoices. The Company is not responsible for purchases made through unauthorized resellers.

3. Acceptable Use

  • Users must not attempt to circumvent proctoring controls, secure exam browser restrictions, or anti-cheating mechanisms.
  • Reverse engineering, copying, redistributing, screen-capturing, or republishing exam content, question banks, recordings, or any platform output is strictly prohibited without prior written consent.
  • Users must not upload malware, run automated scrapers, attempt to access tenants other than their own, or otherwise interfere with the integrity, security, or availability of the Service.
  • Communication between students, instructors, and graders should occur through the Service's official channels. The Company is not responsible for content exchanged outside those channels.

4. Intellectual Property

  • The Service, including its software, design, branding, documentation, and AI models, is the exclusive property of Virtual Data IT and is protected by applicable copyright and trademark laws.
  • The organization retains ownership of question banks, exam content, student data, and other materials it uploads, and grants the Company a limited license to host, process, and display that content solely to provide the Service.
  • Aggregated, anonymized usage analytics may be used by the Company to improve the Service, train models that are not shared across tenants, and produce non-identifying benchmarks.

5. Service Availability & Support

  • The Company targets a high level of availability and may publish a service level objective in the order form. Scheduled maintenance windows will be communicated in advance whenever possible.
  • The Service is regularly updated to add features, improve security, and align with technical and regulatory developments. Some changes may modify or deprecate existing functionality.
  • Technical support is provided through the channels specified in the subscription tier. Response times depend on the severity of the issue and the support plan in effect.
  • The Company is not responsible for issues caused by third-party software, network connectivity, end-user devices, or unsupported configurations.

6. Supported Devices & Environment

To run TrueTest reliably, end-user devices should meet at minimum:

  • Modern desktop or laptop computers running Windows 10/11 or macOS 12+ with an up-to-date Chromium-based browser.
  • Recent iOS devices running iOS 15 or later, and Android devices running Android 10 or later (where mobile delivery is supported).
  • A functioning webcam and microphone for proctored exams, plus a stable broadband connection.
  • Secure Exam Browser (SEB) or the TrueTest desktop client, where required by the exam configuration.

7. Liability & Disclaimers

  • The Service is provided "as is" and the Company makes no warranties beyond those expressly stated in the order form or required by applicable law.
  • The Company is not liable for indirect, consequential, or incidental losses, including lost profits or reputational harm, arising from use of the Service.
  • The Company is not responsible for academic decisions made by an institution based on platform output; final grading and disciplinary outcomes remain the responsibility of the organization.

8. Governing Law

These Terms & Conditions are governed by the laws of the Hashemite Kingdom of Jordan and shall be interpreted accordingly. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Amman, unless the order form specifies another venue.
